Terms of use
Last updated: 2026-10-02
Please read this agreement carefully before installing or using Equinoia (the "Software"). By installing, copying or using the Software you agree to these terms. If you do not agree, do not install or use the Software.
1. Who we are
The Software is developed and provided by Rostyslav Kyryliuk, the developer of Equinoia ("we", "us"). Contact: https://equinoia.com
2. License
We grant you a personal, non-exclusive, non-transferable license to install and use the Software on computers that you own or control, for personal or professional work. The Software is licensed, not sold. We keep all rights that are not expressly granted to you in this agreement.
3. Restrictions
You may not:
- sell, rent, lend, sublicense or otherwise distribute the Software or any part of it, except as allowed for open-source components in section 7;
- remove or change copyright notices, license files or other notices;
- reverse engineer, decompile or disassemble the Software, except to the extent that applicable law expressly permits this despite this limitation;
- use the Software for any unlawful purpose.
4. Your content and the rights of others
The Software is a tool for collecting and organizing visual references on your own computer. Images, videos, links and other material that you save, import, capture or create with the Software ("Your Content") are chosen by you, not by us.
You are solely responsible for Your Content and for how you use it. In particular, you are responsible for making sure that:
- you have the right to save, copy, store and use Your Content, including under copyright law and any other rights of third parties;
- you follow the terms of service of the websites and services from which you save material, including the browser extension and screen capture features of the Software;
- you do not use the Software to bypass or remove copy protection, DRM or other technical protection measures;
- you do not publish, sell or otherwise use material of other people in a way that infringes their rights.
Saving material for your own private reference does not give you the right to publish it or to use it in commercial work. When in doubt, ask the rights holder.
We do not host, review or control Your Content, and we are not responsible for it.
5. Your data
The Software works locally. Your libraries, files and settings are stored on your computer, in the folders you choose. The Software does not send Your Content to us. You are responsible for keeping backups of your libraries; the Software provides a backup function to help with this.
6. Browser extension
The optional Equinoia browser extension sends the image, video or link you select to the Software running on your own computer (address 127.0.0.1). Section 4 applies to everything you save with the extension.
7. Third-party components
The Software includes third-party components, which are licensed under their own licenses. For those components, their licenses apply instead of this agreement where the two differ. In particular, the Software includes FFmpeg (ffmpeg.exe and ffprobe.exe), licensed under the GNU Lesser General Public License version 3 or later. The license text, the version used and where to obtain the source code are in the "licenses" folder in the installation directory. You may replace these files with your own build of FFmpeg. FFmpeg is a trademark of Fabrice Bellard; we are not affiliated with the FFmpeg project.
8. Updates
We may release updates or new versions of the Software. Updates may be provided under this agreement or under an updated agreement that will be shown to you.
9. No warranty
To the maximum extent permitted by applicable law, the Software is provided "AS IS" and "AS AVAILABLE", without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Software will be error-free or work without interruption, or that it will not lose data.
10. Limitation of liability
To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special or consequential damages, or for loss of data, profits or business, arising out of or related to the use of or inability to use the Software, and our total liability is limited to the amount you paid for the Software, if any.
Nothing in this agreement limits liability that cannot be limited by law, such as liability for damage caused intentionally.
11. Consumers
If you are a consumer, nothing in this agreement limits the rights that the law of your country of residence gives you as a consumer and that cannot be waived by agreement.
12. Termination
This license ends automatically if you break this agreement. When it ends, you must stop using the Software and uninstall it. Your Content stays yours and stays on your computer. Sections 4, 7, 9, 10, 11 and 13 continue to apply after termination.
13. Governing law
This agreement is governed by the law of the Republic of Poland, without prejudice to the mandatory consumer protection rules of your country of residence. If any part of this agreement is found invalid, the rest of it remains in effect.
